ILO - Draft conclusions concerning Myanmar Conference paper (November 2011)

Draft conclusions concerning Myanmar

The Governing Body took note of the report of the Liaison Officer, the statement made by the Permanent Representative of the Republic of the Union of Myanmar and the subsequent discussion. In the light of the debate, it adopted the following conclusions:
(1) The Governing Body welcomes the positive developments in Myanmar since March 2011 but remains concerned that serious problems in the use of forced labour persist. The Governing Body calls for the continuation of strengthened resolute and proactive action for the full implementation of the recommendations of the 1998 Commission of Inquiry.
(2) The Governing Body notes that legislation, prohibiting the use of forced labour in all its forms and repealing both the Towns and Villages Acts of 1907, is before Parliament. The Governing Body regrets the absence of consultation and urges the early adoption and coming into force of that legislation. It underlines that full conformity of the new law with Convention No. 29 is required to meet the relevant recommendation of the Commission of Inquiry.
(3) The Governing Body urges that the practice of the imposition of forced labour on prisoners, particularly as porters in conflict areas, cease immediately and again invites the Government to avail itself of the technical assistance of the ILO in the review of the Jail Manual.
(4) The Governing Body welcomes the commencement of direct discussion with the Tatmadaw (armed forces) and looks forward to further substantive policy and behavioural change for the elimination of forced labour and the ending of impunity.
(5) The Governing Body also welcomes the commencement of, and encourages the continuation of, direct discussion with the Ministries of Finance and Planning and looks forward to confirmation that planning and financial management processes sufficiently provide for the payment of wages in government operational and project activities.
(6) The Governing Body welcomes the release of U Zaw Htay, U Nyan Myint, Daw Su Su Nway, U Min Aung, U Myo Aung Thant and other labour activists and strongly urges the early release of U Thurein Aung, U Wai Lin, U Nyi Nyi Zaw, U Kyaw Kyaw, U Kyaw Win and U Myo Min, as well as other labour activists remaining in detention.
(7) The Governing Body again calls on the Government to facilitate the free access of the Liaison Officer to detainees and to effect the reinstatement of the advocacy licences of U Aye Myint and Ko Pho Phyu.

(8) The Governing Body again stresses the critical importance of a comprehensive proactive approach encompassing not only the continuation of awareness-raising activities and the management of the complaints mechanism but also the effective prosecution of forced labour perpetrators, military and civilian, under the Penal Code.
(9) The Governing Body notes the priority action taken towards the resolution of a number of long-standing complaints in the Magwe region and looks forward to receiving confirmation that they are at last satisfactorily resolved.
(10) The Governing Body welcomes the expanded awareness-raising activities being undertaken, including the production and distribution of the information brochure in Shan language, and encourages the continuation of this partnership activity and its expansion into other languages. The Governing Body further notes the positive initiative of the proposed training of police personnel to ensure their understanding of their role and responsibilities, in collaboration with the military, in the elimination of forced labour, including in respect of procedures to address the continuing problems of under-age recruitment and their alleged desertion.
(11) The Governing Body, whilst recalling all of its previous conclusions and recommendations, encourages the ILO and the Government in their continuing positive collaboration within the framework of the Understanding and its Supplementary Understanding which should be further extended in February 2012. It also encourages the Government to respond positively to all ILO related recommendations made by the Human Rights Council during the Universal Periodic Review.
(12) In light of the above, the Governing Body considers it essential to strengthen the capacity of the Liaison Office and therefore reiterates in the strongest terms its repeated calls on the Government to issue without delay the visas necessary to this effect.
(13) The Governing Body notes the calls for a review by the International Labour Conference of the mandate defined by the 1999 resolution and will consider this issue at its March 2012 session.

ASEAN: Set Benchmarks for Burma on Rights

Press Government to Free Political Prisoners, End Impunity for War Crimes (Manila, November 17, 2011) – The Association of Southeast Asian Nations (ASEAN) should set clear human rights benchmarks for Burma as a condition for its chairmanship of the regional grouping in 2014, Human Rights Watch said today. These benchmarks should include the immediate release of all political prisoners, the repeal of laws used to repress peaceful dissent, the end of abuses in ethnic conflict areas, and accountability for perpetrators of war crimes. “Burma has long been a millstone around ASEAN’s neck that won’t be removed by making Burma the chair in 2014,” said Elaine Pearson, deputy Asia director at Human Rights Watch. “ASEAN needs to set clear benchmarks for reform and closely monitor progress.” Despite two general prisoner amnesties in May and October in which 316 political prisoners were released, the Assistance Association of Political Prisoners of Burma estimates that 1,669 political prisoners currently remain behind bars. The opposition National League for Democracy has also produced a partial list of 591 political prisoners based on information gathered from its lawyers, social workers, and local party officials who have had contact with the political prisoners or their families. Human Rights Watch urged ASEAN leaders to press the Burmese government to account for all 1,669 prisoners apparently being held for offenses related to peaceful political activity. The government should release all those imprisoned on politically motivated charges, whether they have been convicted under Burma’s repressive political laws or for common criminal offenses. The situation needs to be carefully followed to ensure that those released are not later rearrested, as has happened in the past. The Burmese government should provide proper accounting of all prisoners throughout the country, Human Rights Watch said. Given the lack of transparency in Burma’s justice and penal system, the government’s practice of moving prisoners to remote locations, and its refusal to allow access to the International Committee of the Red Cross and other independent organizations, families of all prisoners face terrible hardships. The onus is on the Burmese government to account for each prisoner, not prisoners’ families, opposition parties such as the National League for Democracy, or outside organizations. “ASEAN should tell the Burmese government to stop using political prisoners as bargaining chips to deflect international pressure,” said Pearson. “ASEAN members need to ensure that all of Burma’s prisoners are fully accounted for, and those held for political reasons are immediately released.” ASEAN should call on the Burmese government to repeal all laws that repress nonviolent political activity, Human Rights Watch said. The new parliament has tabled bills on forming trade unions, permitting peaceful assembly, and amending the political party registration laws, which may open the way for participation by the National League for Democracy. ASEAN should monitor recent reforms to Burma’s laws to ensure that their implementation upholds basic rights. ASEAN should press the Burmese government to end grave rights abuses in ethnic areas and prosecute those responsible, Human Rights Watch said. Serious abuses amounting to war crimes in Kachin, Shan, and Karen States have escalated in 2011. Since June, over 30,000 civilians have been displaced in Kachin State, fleeing Burmese army abuses such as unlawful forced labor, extrajudicial killings, and attacks on civilians, with several thousand seeking refuge in China. Ongoing abuses in conflict areas show the culture of impunity that remains pervasive within the ranks of the Burmese military. Emergency relief for Burmese migrant workers in flooded areas

ESB Food Factory Workers
On 2 November 2011, members of the Labour Rights Promoters and Defernders (LRPD) were informed by Burmese migrant workers at the ESB food factory in Nakon Pathom that they were stranded because of the floods and only had enough food for two or three days.  Electricity had been cut by the apartment owner and that they had to request the landlord to provide cooking gas.
LRPD members alerted about their plight to friends, sympathizers and other migrant workers and urgently organized a relief trip to Kha Thonmai Soi (9), Phutttha Monton, Sai 4, Sam Phrum District, Nakhon Pathom Province, Thailand.  The workers there were provided with emergency supplies.
About 200 Burmese migrant workers had been working at that factory and most of them have now gone back or are making preparations to go back to Burma.  

Flood Victims of Phuttha Monton

On 3 November 2011, flood waters entered Phuttha Monton area affecting many factories where Burmese migrant workers were working.
The LRPD organized a relief trip to the region by alerting Burmese migrant workers from areas unaffected by floods to join the relief efforts.
On 10 November 2011, a joint relief team of LRPD members and Burmese migrant workers from Vita Food factory went to Phutta Monton area to help the flood victims. There was difficulty in renting boats to carry supplies to the flooded area. It took three hours before a boat became available to transport relief supplies to Puttha Monton Sai 5, Sam Phrum District, Nakhon Pathom Province.
About 2,500 Burmese migrant workers were staying at the apartments in that flooded area. They were either waiting for their unpaid wages or for the factories to reopen. Some workers returned to Burma after they received their wages but some undocumented workers could not, even if they wanted to, because they did not have work permits or passports.
Living situation:
When we arrived at the apartment where about 900 workers were staying, they explained that the landlord had cut off the electricity and water supply and was selling candles and water at steeper prices.
Those living in that apartment claimed that they already paid their rents and also the fees to use electricity and water. When they asked the landlord for water and electricity, the owner showed them his handgun and threatened to hurt anybody who demanded water and power. The workers were told to move out if they were not happy with the situation. 
When the LRPD team visited the apartment, the living conditions were horrible. The area was reeking with bad smells and flood waters around the area were dirty. Potable water was not available as there is no running water. Plastic gabs used human wastes and dumped into the water. Some workers, who were fortunate, did their cooking at a nearby apartment where electricity was provided and where their friends were living.
Elsewhere, no electricity or fresh water is available and workers living in unsanitary conditions face serious health risks.
Relief Needed:
The Burmese migrant workers who are flood victims need first aid kits, medicines, and precautionary health protection measures, in addition to food and water.  Presently, although Thai relief teams and NGOs are distributing relief goods, their arrival is uncertain and irregular.  The Burmese workers said they received some supplies from Thai soldiers and police.

ျမန္မာနိုင္ငံကို အာဆီယံဥကၠဌေပးရန္ သေဘာတူ။

၂၀၁၄ အာရွ ေဒသဆိုင္ရာ ထိပ္သီး အစည္းအေဝးမ်ားအား အိမ္ရွင္ႏိုင္ငံအျဖစ္ ျမန္မာ က က်င္းပရန္ အာဆီယံ ေခါင္းေဆာင္မ်ားက ႏွစ္ေထာင္းအားရ သေဘာတူမႈကို ေဖာ္ျပၾကေၾကာင္း အင္ဒိုနီးရွား
ႏုိင္ငံျခားေရးဝန္ႀကီး မာတီနာတာလီဂါဝါ Marty Natalegawa အား ကိုးကား၍ Jakata Globe သတင္းက ေရးသား ထားသည္။

“(ေရွ႕အပါတ္ ဘာလီ အစည္းအေဝးမွာ) ျမန္မာအတြက္ ေထာက္ခံေပးမွာလားလို႔ ေမးရင္ က်ေနာ့္အေနနဲ႔ အျဖဴအမဲ အေျဖ မေပးႏိုင္ပါဘူး” ဟု Marty Natalegawa က သတင္းေထာက္မ်ားအား ေျပာၾကားလိုက္ၿပီး ျမန္မာႏိုင္ငံ အေျခအေနႏွင့္ ပတ္သက္၍ “အကယ္၍ (အခု) ႏုိဝဘၤာ အေျခအေနကို ၿပီးခဲ့တဲ့ ဇူလိုင္နဲ႔ ေမလတုန္းက အေျခအေန
ေတြနဲ႔ ႏိႈင္းယွဥ္ခိုင္းရင္ေတာ့ က်ေနာ့္အေနနဲ႔ ပိုၿပီးေတာ့ အေကာင္းျမင္ အေပါင္းလကၡဏာ ျပတယ္လို႔ ခံစားရပါ တယ္” ဟု မၾကာေသးမီက ျမန္မာႏိုင္ငံသို႔ သြားေရာက္ခဲ့သည့္ လက္ရွိ အာဆီယံ ဥကၠ႒ အင္ဒိုနီးရွားႏုိင္ငံ

ၿပီးခဲ့သည့္ ဇူလိုင္ ထိပ္သီးအစည္းအေဝး ထုတ္ျပန္ခ်က္တြင္လည္း အိမ္ရွင္ႏိုင္ငံလုပ္ရန္ “ျမန္မာရဲ႕အဆိုျပဳခ်က္ကို အေပါင္းလကၡဏာျပ စဥ္းစားၾကရန္” တိုက္တြန္းခ်က္တခု ထူးျခား အေရးပါလွစြာ ေဖာ္ျပထားၿပီးျဖစ္သည္။

ဥကၠ႒အျဖစ္ ျမန္မာအေနႏွင့္ အာဆီယံကိုယ္စား စကားေျပာရမည္ျဖစ္ၿပီး ေဒသတြင္း အစည္းအေဝးမ်ားလည္း အိမ္ရွင္အျဖစ္ လက္ခံက်င္းပေပးရမည္ျဖစ္သည္။ ထိုအထဲတြင္ အေမရိကန္ ျပည္ေထာင္စု ပါဝင္သည့္ အေရွ႕အာရွ ထိပ္သီးအစည္းအေဝးလည္း တခုအပါအဝင္ျဖစ္သည္။

လာမည့္ ရက္သတၱပါတ္အတြင္း အင္ဒိုနီးရွားႏိုင္ငံ ဘာလီၿမိဳ႕တြင္ က်င္းပမည့္ အစည္းအေဝးသို႔ အိုဘားမား တရားဝင္ တက္ေရာက္မည္ ျဖစ္သည္။ ျမန္မာတြင္ အာဆီယံထိပ္သီး အစည္းအေဝး က်င္းပျဖစ္လွ်င္ ျမန္မာအစိုးရ ကို မာမာတင္းတင္း ဆန္႔က်င္ေနခဲ့ေသာ အေမရိကန္ႏိုင္ငံ၏ သမၼတသည္လည္း အစည္းအေဝး လာတက္ရဖြယ္ ရွိေနသည္။

အေမရိကန္ႏွင့္ ျမန္မာ ႏွစ္ႏိုင္ငံဆက္ဆံေရး ေခ်ာေမြ႔ ေျပလည္ေစေရး အတြက္ “ေနျပည္ေတာ္ေရာ ဝါရွင္တန္ေရာ ဟာ နားလည္မႈ လြဲမွားေစႏိုင္တဲ့ ဝန္းက်င္ကို ေရွာင္ရွားၿပီး ယံုၾကည္မႈ တည္ေဆာက္ဖို႔ လိုပါတယ္။ ရွင္းလင္းတဲ့ ဆက္သြယ္ေရး လမ္းေၾကာင္းေတြ ေသခ်ာခိုင္မာ ရွိေနရပါမယ္” ဟု အေမရိကန္ သံအမတ္ ဒဲရစ္မစ္ခ်ယ္ Derek Mitchell က ေသာၾကာေန႔က အေမရိကန္ သံု႐ုံးတြင္ ျပဳလုပ္ခဲ့သည့္ သတင္းစာ ရွင္းလင္းပြဲတြင္ ထည့္သြင္းေျပာၾကားခဲ့သည္။

အလုပ္သမားမ်ား၏ ေျပာျပခ်က္မွာ - ၎တို ့အေနျဖင့္ မည္သည့္အခ်ိန္တြင္ ေရက်သြားမည္ကို မသိေသာ္ လည္း စက္ရုံျပန္ဖြင့္ မည့္အခ်ိန္ကို ေစာင့္ေနေၾကာင္း၊ အကယ္၍ အလုပ္ကို လ ႏွင့္ ခ်ီ၍ ပိတ္ထားမည္ဆိုပါက အခက္အခဲမ်ားစြာ ၾကဳံရမည္ျဖစ္ေၾကာင္း၊ မိမိတို ့ အဖြဲ ့မွ ကူညီမႈမွာလည္း (၃) (၄) ရက္ ခန္ ့သာ စားသုံးႏိုင္ မည္ျဖစ္ေၾကာင္း၊ ရိကၡာအခက္အခဲမွာ ေစ်းထြက္၀ယ္ရန္ အခက္အခဲရွိျခင္း၊ ေငြေၾကးအခက္အခဲရွိျခင္း၊ ကုန္ေစ်း ႏူန္းမွာလည္း ၾကက္ဥ တစ္လုံး (၇) ဘတ္အထိ ေစ်းတက္ေနျပီး ေရာင္းမည့္ဆိုင္ပင္မရွိေၾကာင္း ႏွင့္ မ်ားစြာ ၾကပ္တည္းမႈမ်ားႏွင့္ၾကံဳေတြ ့ေနရျပီး မခံႏိုင္ေတာ့သည့္အဆုံးတြင္ ရဲဖမ္းလွ်င္လည္း ဖမ္း ျမန္မာျပည္သို ့ျပန္ မည္ ျဖစ္ေၾကာင္း၊ အခ်ိဳ ့မွာ Passport မရွိပဲ အလုပ္လုပ္ခြင့္ လက္မွတ္မ်ားသာရွိၾကေၾကာင္း သိရွိရပါသည္။

၎ စက္ရုံပတ္၀န္းက်င္ရွိ အျခားစက္ရုံမ်ားတြင္လည္း အလုပ္လုပ္ေနေသာ ျမန္မာအလုပ္သမား ၅၀၀ မွ ၆၀၀ ပတ္၀န္းက်င္အထိရွိေၾကာင္း အခ်ိဳ ့မွာ ျမန္မာႏိုင္ငံသို ့ ျပန္သြားၾကျပီျဖစ္ေၾကာင္း သိရွိရပါသည္။
